Application Of Evidence

Evidence Act contains the fundamental principle on which conclusion may be arrived at in a case. Only the broad principles of rules of evidence are contained in the Evidence Act, 1872, whereas Code of Criminal Procedure come into force in 1898 and Code of Civil Procedure was enacted in 1908. Naturally, the rules of evidence which may be applied in civil and criminal cases are not specifically mentioned in the Evidence Act, 1872.
I have tried my best to include all the principles of Evidence which will be applicable in trying different kinds of cases and suits. While discussing such rules of evidence in different law, I have also considered the decisions in this regard given by the superior courts.

This 2nd edition is far more exhaustive and some important matters which were not included in the 1st edition are also included in this edition. I hope this edition will be of immense help to the Judge, Lawyers and even the senior students of law.
